BACKGROUND:

 

In March 2021, the Fair Work Amendment Act 2021 introduced significant changes to legislation concerning casual employment. The changes affect all businesses, of all sizes, in all industries who employ (or intend to employ) casuals.

 

The changes are now in full force, effective 27 March 2021, and include:

  • A new definition of “casual employment”;
  • New casual conversion requirements and employee entitlements;
  • The ability to offset casual loading already paid to an employee;
  • Introduction of a new Casual Employment Information Statement.

 

All businesses should be aware that the changes impose additional obligations on employers and rely heavily on the correct clauses being included in the employment contract (among other things) in order for a business to be protected. By not understanding these changes or failing to take appropriate action (such as not updating employment contracts or not assessing casual conversion entitlements), businesses may be at risk of costly and time consuming claims, penalties and reputational damage.
